This dispute scenario stems from the directing of politically non-hegemonic public spheres to make effective the participation of the inhabitants of the Railway Suburb neighborhoods in the process of democratic construction of the city. In this public sphere, historically excluded social actors have acted within decision-making arenas to vocalize interests and issues revolving around the right to the city related to the construction of the new transport mode, thematizing problems of urban mobility, changes in fare affordability, the need to transport goods, among other demands not addressed by the government of the State of Bahia. The central question of this research, therefore, lies in the consequences of actions opposing and supporting public policy, which were analyzed from a theoretical-empirical study of this path of dispute for the transformation of the city in the face of the obstacles imposed by the new reason of the world implemented by urban entrepreneurship and corporate governance, which characterize the operations of this government. This governance represents a new global approach to neoliberalism in decision-making and the implementation of public policies, based on market mechanisms, decentralization of implementation, and depoliticization of relations with citizens. Nevertheless, the actors from the neighborhoods affected by the aforementioned project sought the institutional legitimacy of the MPBA to carry forward their discussions. Based on these premises, this research was developed with both a theoretical and empirical character, through a methodology that sought to encompass triangulation among different methods, sources, and techniques, using bibliographical research and documentary analysis of the instituted procedures and related secondary data, whose coding was carried out with the aid of the qualitative research software Atlas.ti. In view of this, it is intended to contribute to interpretations and to the field of public policy analysis, but also to add to citizens’ understanding of this process and of the instruments and strategies available to realize an active citizenship capable of transforming social reality. On the one hand, Non-Governmental Organizations, activists and HIV-positive people applauded the measure, while on the other, pharmaceutical multinationals and the governments of several countries, especially the United States, expressed dissatisfaction, claiming that the measure was unnecessary. The compulsory licensing of Efavirenz was declared in 2007, in response to the serious HIV/AIDS epidemic that had been ravaging the world since the 1980s, raising concerns about the sustainability of treatment programs and the continuity of drug supplies, especially in undeveloped countries. At the time, Brazil already had an internationally recognized policy to combat HIV/AIDS, and its laws to support people living with AIDS and the free distribution of antiretroviral drugs showed that the country was willing to negotiate and, if necessary, adopt extreme measures, as in fact happened. In this context, this study aims to analyze the compulsory licensing of Efavirenz in the light of the TRIPS Agreement, identifying the reasons and grounds that Brazil used to justify this decision. To achieve this goal, the study begins with an analysis of Intellectual Property, going through the patent system and its challenges in the current Brazilian scenario, identifying the gaps left by TRIPS, and addressing how its flexibilities impact on the Brazilian legal system. In order to understand the seriousness of the situation and assess the plausibility of the measure, official statistical data is examined, as well as the historical context in which the licensing took place. In addition, the study investigates the legislative updates that have proved necessary to harmonize theory with real practical needs, addressing prevention strategies currently used and how they aim to combat HIV infection. Finally, critical considerations are presented on the compulsory licensing of Efavirenz, assessing the implications and consequences of this measure both on the international stage and in Brazilian public health policy. In Brazil, this process has been accompanied by the formulation of a National Policy for Attracting Data Centers, marked by tax incentives, special taxation regimes, and discourses of digital sovereignty and economic competitiveness. However, the incorporation of socio-environmental and territorial dimensions into this policy remains fragmented and insufficient. Given this context, this research aims to analyze how Brazilian policy to attract data centers, in the context of the global race for artificial intelligence, has addressed the environmental risks and damages associated with the expansion of this infrastructure, taking as a case study the territory of the Anacé indigenous community in Ceará, affected by the project to install a data center linked to the company ByteDance/TikTok.; La rápida expansión de la infraestructura digital asociada a la inteligencia artificial ha reposicionado a los centros de datos como elementos estratégicos de la economía contemporánea, a la vez que intensifica las presiones sobre los activos ambientales, los territorios y las comunidades locales.
